NSW Government Getting Flak For Light Rail Project Lawsuit

The Opposition is giving the NSW flak for not getting a good legal team and financial advisor in Australia, which has lead to what they consider as a ‘bad call’ regarding a $1.1 billion lawsuit on the George Street light rail project, which holds a reputation as Sydney’s problem project.

NSW’s Shadow Minister for Planning and Infrastructure, Michael Daley says that it seems that Gladys Berejiklian and Andrew Constance are being dense again, having forgotten that the George Street project involves hundreds of millions of Aussie taxpayer money, all  put on the line. If the litigation continues, the issue will likely be put on hold until the post-electoral season.

The Spanish contracting firm Acciona, designer and constructor of the light rail line, filed a $1.1 billion lawsuit against the NSW government. The lawsuit was fined in late of March 2018, and Transport for NSW had reportedly decline to mediate on the case, which has claims regarding misleading and deceptive conduct.

The firm sent its statement of claim to NSW a month before they filed it in the NSW Supreme Court, asking for mediation with a final request, which was then rejected by the court. Transport for  NSW, meanwhile, did not comment as to why they weren’t pursuing mediation for the case, saying that information that would be relevant to fixing the dispute was “commercial-in-confidence”.

A spokesperson from Transport for NSW claims that they have already engaged in discussions with ALTRAC and Acciona to deal with the problem, but they weren’t successful. ALTRAC, the consortium that contracted the work to Acciona, did not release a statement on the matter.

Arbitration or mediation is the preferred method for lawsuits, according to contractors and any financial advisor in Australia, as they’re cheaper and faster than court proceedings, whilst allowing for the dispute’s details to remain private. However, if the arbitration ended up in favour of the contractor, and ordered the government to compensate the contractor, then the government would have to deal with that in the days leading into the March 2019 state election.

The government has repeatedly stated that this project will be both on time and on budget, but with the demand from Acconia, one they can very much follow up, an additional interest of $1.1 billion will be incurred and the project will, at the very least, be a year late.

Reportedly the aim of the exhibit is not only to show diversity in barristers beyond the old Anglo-Saxon male stereotype, but also to display the bar as an approachable, welcoming environment across the board, for both aspiring barristers and clients.

President of the Victorian Bar Association, Matt Collins, says that barristers come from all walks of life; pregnant women, surfers, and the like. The bar is now accepting younger people, it’s now more gender and ethnically diverse, and the photos show it, plain and simple.  The photos even have barristers wearing casual wear, conversing, and smiling instead of sporting the stereotypical dour lawyer look. He says that it’s unfair to stereotype barristers as old white guys wearing wigs.

In the 1930s, a photo of the whole Victorian bar had 150 white men, all looking alike. 50 years later, in the 80s, there was only one woman barrister – Susan Crennan, who then moved on to become a High Court judge. Around that time, only about 5% of barristers were women.

About 40% had a parent born overseas, with 15% born outside of Australia, and 1.2% of barristers from Indigenous groups. Collins says that he’s very serious about changing the image of barristers into something more modern, more accessible, approachable and amiable.

Pöyry Gets Contract For Thai Biomass Power Plant

Finnish company Pöyry Energy Inc. is a global engineering and consultancy firm with international clientele, with a primary focus on the energy and industrial sectors. Sino-Thai Engineering and Construction Public Co. Ltd recently awarded the Finnish engineering firm with the contract for the development of a new 20.6 MW biomass power plant, under ownership by Chana Green Co. Ltd., a private energy company and subsidiary of Gulf Development Co. Ltd. The new renewable energy plant will be built on Songkla, in Thailand’s Chana District.

STECON will be handling the EPC phase of the project, which will use rubber wood as its fuel supply. Pöyry will handle the process and plant engineering, as well handling plant layout design. Additionally, and civil, structural, mechanical, and piping design will also be handled by Pöyry. Pöyry will handle the construction efforts, including procurement of any necessary materials, like any flexible connector or the like. Thailand’s Small Power Producer scheme, is what allowed for the new power plant’s realization, which means that the plant’s 20.6 MW power output will be sold to the Electricity Generating Authority of Thailand. The project received approval from the government early in March of 2018.

Pöyry Regional Director Petteri Härkki, expressed excitement in a statement, saying that Pöyry is looking forward to their cooperation with STECON and Gulf for the biomass project. He says that this contract will strengthen the company’s foothold on the thermal power and renewable energy industry in Thailand, where the company already has had a hand in the development of 50 power plants across the country. Additionally, he says, it strengthens the company’s position as Thailand’s leading global power industry engineering consultancy firm.

The details of the deal has yet to be revealed, though it has been confirmed that the transaction is recognized by the Energy Business Group order stock for H1 2018.
